Terms and Conditions of Van Rental
1. Introduction
(a) These Terms and Conditions of Business govern the legal relationship between You ("You"
“Yourself” Yourselves”) and Camel Hire ("the Company" and or "We" or “Our” or "Us").
(b) By making a Reservation (as defined below) You are deemed to have read and to have
accepted these Terms and Conditions of business to the exclusion of all other terms and
conditions.
(c) No changes can be made to these Terms and Conditions except in writing signed by a director
of the Company. No employee or agent of the Company is authorized to waive or modify any of
these Terms and Conditions except in writing and then only after obtaining the authorization of a
director of the Company.
2. Our Obligations to You
(a) We agree to provide to You a quotation for the supply to You of a hire vehicle at a specified
location, on a specified date, for a specified price (a “Quotation”).
(b) We undertake upon your acceptance of a Quotation to make a reservation in your name in
accordance with Our Quotation.
(c) We will not take payment from You for rental until both parties have confirmed the particulars
of the rental (Dates / Times / Rental Length / Drivers / Overseas Rentals).
(d) We agree to use reasonable care and skill in the performance of these services.
3. The Quotation
(a) The Quotation given to You will, unless specified otherwise, include the hire of a vehicle,
mileage restrictions, insurances, Collision and Damage Waiver payments, and comprehensive
breakdown cover
(b) Quotations cannot be given for specific types and or models of hire vehicles. Therefore, all
Quotations will be valid for a “class” of hire vehicle only rather than for a specific model of hire
vehicle.
(c) Quotations are for the use of a hire vehicle within national boundaries. If You wish to use a hire
vehicle to cross any national boundary, You must advise us at the time You request a Quotation.
You must also obtain Our advanced consent to use and pay Us any additional charges or fees
which it levies for granting such permission.
(d) Hire vehicles cannot be used for off-roading or any other unusual use. Hire vehicles are only
covered by insurance when used on adopted legal roads and private paved or tracked roads
leading on to adopted legal roads.
4. Your Duty to Us
In order to provide You with an appropriate Quotation You agree to:
(a) Provide Camel Hire with your correct travel details: location, dates, ferry times etc.(if
applicable).
(b) Inform Camel Hire at the time of making your Reservation of any endorsements on Your
and/or any additional drivers driving licence. In particular but without limitation, all convictions for
driving whilst under the influence of alcohol (DRxx) or driving without Insurance (INxx) in the
preceding ten year period must be disclosed to Us.
(c) Inform Camel Hire if You or anyone that it is proposed shall drive the hire vehicle are aged
under 25 or over 75 (Age Specific limitations are imposed for insurance purposes. Please contact
us in advance if the proposed driver(s) are aged under 25, or over 75).
(d) Request a hire vehicle suitable for the size of your party and items you wish to transport. Hire
vehicles are insured for a maximum number of passengers and operate under strict vehicle load
limits. You should ensure that the hire vehicle You make a Reservation for is of a suitable size.
5. Your Contract with the Us
(a) When You collect your hire vehicle You will be asked by the Us to sign a legally binding
contract between Camel Hire and Yourselves that will govern the arrangements between both
parties in relation to the collection, use and return of the hire vehicle (a “Vehicle Rental
Agreement”).
(b) If You have any issues to resolve in relation to the collection, use, return or condition of your
hire vehicle You must take these issues up directly with Us.
(c) If You have any issues to resolve in relation to the provision of additional services You must
take these issues up directly with Us.
(d) At the time of collection of your hire vehicle You must provide Us with yours and any other
nominated driver’s full and valid driving licence. If you have been convicted of any motoring
offence which is still recorded on your licence regardless of expiry, we must be informed of this
during the booking process. If you have ever been convicted of a drink driving offence (DRxx),
insurance offence (INxx) or any other serious road traffic violation we must also be informed at
the time of booking, failure to do so may result the vehicle being refused to the driver on the day
of hire.
(i) Upon arrival to collect your vehicle, we require yours, and any other nominated drivers photo
card driving licence or full paper licence, along with your National Insurance Number or DVLA
Check Code.
(ii) Drivers must have held their licence for a minimum of one year.
(iii) Photocopies of driving licences will not be accepted.
(e) We cannot guarantee that You will be provided with the exact make and model of hire vehicle,
as We reserve the right to supply hire vehicles by “class” rather than by make and/or model.
(f) We retain the right to refuse to provide a hire vehicle to any person who appears to be unfit to
drive or does not meet eligibility requirements. In such circumstances your contract will be
terminated immediately and We will have no liability to You.
(g) You must return your hire vehicle within the agreed rental period. No refunds will be made on
partial rentals, and late returns will be charged appropriately
(h) The use of the hire vehicle will be subject to the laws of the country in which it is driven.
(i) If for any reason you are not content with the condition of your hire vehicle You must inform Us
immediately.
6. Insurance Excess, Deposits and Charges
(a) Upon collection of the hire vehicle You must produce Us with a valid credit or debit card in the
name of the hirer.
(b) The Standard Insurance Excess (CDW) amount is £750.00. This is collected as a pre-
authorised transaction and held for no longer than 7 days by your bank or card provider. This
amount shall be released back to You automatically, providing the hire vehicle is returned to Us in
the same condition it leaves Us in.
(c) The Standard Insurance Excess (CDW) amount can be lowered upon request to £250.00. This
option incurs a £15.00 per day of rental surcharge.
(d) For hires exceeding a 6 day period, the agreed Insurance Excess amount (£750.00 or £250.00)
will be taken and held by Us as a complete transaction and refunded back to You once the van has
been returned to us.
(e) Any damage above the height of 5 foot (1.52m) is NOT included in any excess or waiver, and
You will be responsible for the full cost of any damage above 5 foot (1.52m).
(f) Failure of the hirer to disclose any accident or collision occurring over the term of the rental
agreement will result in the hirer being liable for all subsequent costs, claims and third-party
damage incurred by Us, or Our insurers.
(g) If damage caused to the vehicle is deemed to be as a result of the hirers negligence, Camel
Hire will hold the hirer responsible for the full repair costs.
(h) The vehicle should always be returned with the same amount of fuel it had on collection. All
vehicles are supplied with a full tank of diesel. If the hire vehicle is not returned with a full tank of
diesel, You will be charged locally for the diesel required to fill the tank together with a service
charge of £25.00 for refuelling. The cost of refuelling and associated charges shall be deducted
from your pre-authorised amount.
(i) All vehicle rentals should be returned to site no later than 08.30am on the final day of hire.
Failure to return a van by this time will result in a £50.00 charge. This charge will be automatically
deducted from your Collison and Damage Waiver.
7. Additional Charges
(a) If You require a sack truck / trolley You should inform Us of this requirement at the time of
booking. Such items will incur additional charges, the price of which is available on request. All
payments for additional items are to be made to us alongside the hire charge. We do not accept
any liability whatsoever for the use of these items by the hirer.
(b) Each van has a daily mileage limit of 200 miles for every agreed day of hire. This limit is
cumulative across multiple days of hire. (For instance, a two-day hire will include a 400-mile limit,
3 day hire limit 600 miles etc)
(c) Any mileage accrued above the daily (or cumulative) limit shall be charged at £0.15 per
complete mile. This amount will be added to your completed rental agreement, with any monies
owed to Us retained from the CDW payment.
(d) If You wish to take a rental vehicle outside the UK, we must be informed at the earliest
possible convenience to ensure proper documentation is issued. It is Our responsibility to ensure
that all vehicles are supplied with the necessary documentation (VE103) and covered by European
breakdown cover, and to ensure the vehicle has the necessary ‘overseas’ equipment e.g. warning
triangle, nationality sticker, first aid kit etc. in line with local laws. These items will be supplied by
Us.
(e) There is a one-off charge of £65.00 for overseas European hire by Us to ensure that all
relevant documents, insurances, and safety equipment is provided for the start date of the vehicle
hire. This charge will form part of the overall cost of the hire and is payable by You at the same
time as the rental hire.
(f) You are responsible for payment of any fines, parking tickets, congestion charges etc. Any
charges that arise after the hire period will be billed to You the customer, from Us. Under no
circumstance do We accept any liability whatsoever for any administration charges levied as a
result of this.
8. Limitation / Exclusion of Liability
(a) We shall have no liability to You for any loss, damage, cost, expense or other claim for
compensation arising from any information or instructions supplied to Us by You which are
incomplete, incorrect, inaccurate, illegible, out of sequence or in the wrong form, or which arise
from late arrival or non-arrival of the same or any other fault attributable to You.
(b) If You use our website and/or contact Us by telephone but do not make a Reservation then We
exclude all liability to You to the fullest extent permitted by law.
(c) Except in respect of death or personal injury caused by Our negligence, We shall not be liable
to You for reason of any representation (unless fraudulent) or any implied warranty, condition or
other term or any other duty at common law or under the express terms of any contract for any
loss of profit or any indirect special or consequential loss, damage, costs, expenses or other claims
(whether caused by the negligence of the Company, its servants, agents or otherwise) which
arises out of or in connection with the provision of a Quotation, a Reservation or any other services
provided by Us, and our entire liability under or in connection with the provision of a Quotation,
the making of a Reservation and any other services supplied shall not exceed the amount paid by
You to Us for a Quotation and or Reservation and other services.
(d) We shall not be liable to You or be deemed to be in breach of these Terms and Conditions by
reason of any delay in performing or any failure to perform any of our obligations in relation to the
services to be provided to You if the delay or failure was due to any cause beyond our reasonable
control including without limitation: strikes, lockouts, adverse weather conditions, security alerts,
airport closures, war, riots, civil commotion, terrorist actions, Government restrictions and/or ‘acts
of God’.
9. Cancellation / Amendments
(a) Following the making of your Reservation You can cancel your Reservation free of charge up to
48 hours before the agreed rental period begins. Any cancellations or amendments made after this
period will attract the appropriate charge as set out in these Terms and Conditions.
(b) Any cancellation must be made either in writing to Us (emails should be sent to
info@camelhire.co.uk, and are only accepted during working hours), or by phone call. The
cancellation of Your Reservation will attract the following charges:
(i) Within a 24 hour period of the hire agreement starting, there will be no cancellation refund at
all.
(ii) If You cancel Your Reservation between 24 and 48 hours before the rental agreement starting,
there will be a £30.00 charge.
(iii) Reservations cancelled before the 48 hour limit can be done so with no additional charges
(iv) Amendments to a Reservation date that does not result in cancellation can be done so up to
24 hours before the original rental start date free of charge, providing these changes can be
accommodated.
(c) All cancellations must be received via e-mail or phone call, and must be received at these
offices during our normal hours of business which are Monday to Friday 8.30am to 5.00pm, and
Saturday 8.30am – 12.00pm. Any Cancellation received outside of these hours will not be read or
accepted until the start of the next business day.
(d) There is an internal processing and administration charge associated with any agreements or
rentals that go into arrears and this will be levied in all instances where monies are owed
to Camel Hire. This will be added to any debt of more than seven calendar days and will be due
upon payment of any funds owed, this fee is £25.00.
(e) Where any debt remains unpaid after seven days we reserve the right to charge interest on the
monies owed, such interest shall be calculated at the rate of 4% above the Bank of England base-
lending rate for the time being in force, on a day-to-day basis.
(f) All accounts should be paid on the due date. Should payment not be received without any valid
reason and it becomes necessary to refer debts to an external agency for Collection, Tracing or
Litigation, then all such costs incurred will be added in full to the outstanding debt
10. General
(a) We are entitled to change these Terms and Conditions at any time and You are therefore
advised that each time you make a Reservation with Us either from a website or by telephone, you
should check the latest copy of our Terms and Conditions of business which will apply to that
Quotation or Reservation.
(b) No failure or delay by either You or Us in exercising any rights under these Terms and
Conditions shall be deemed to be a waiver of that right and no waiver by either You or Us of any
breach of these Terms and Conditions by the other shall be considered as a waiver of any
subsequent breach of the same or any other provision.
(c) You are always responsible for any traffic fines, toll fees, congestion charges, parking tickets all
optional extras, all fuel charges, insurance excesses and deposits.
(d) Any complaints made to Us must be supplied in writing within 7 days of the completion of the
hire. We will not accept any responsibility for any complaints not raised with Us within such time
period.
(f) In the event of damage to the hire vehicle You should refer to the Vehicle Rental Agreement.
However in addition to complying with the Vehicle Rental Agreement You must also: -
(a) Notify Us immediately
(b) Not repair the hire vehicle yourself
(c) Obtain a signed police report in respect of any accident
(d) Complete an accident form (obtainable from Head Office)
(e) Obtain details of any third parties
(f) Obtain a signed “check out form” when the hire vehicle is returned
(g) You must NOT admit or acknowledge any liability. Failure to follow any of these requirements
and forward all relevant information to Us upon your return will seriously jeopardize and or
prevent any successful claim being made by You or by Us for the return of any insurance excess
charges that You may have had to pay to us (such claims being possible where damage to the hire
vehicle is attributable to the fault of another only).
(j) It may be possible to extend the duration of a Hire period, however this must be arranged prior
to any extension by contacting us, whereby any extension arranged will be charged at the
standard daily rate.
11. English Law
English Law shall apply to these Terms and Conditions and both You and the Company agree to
submit to the exclusive jurisdiction of the English Courts
